Terms of Service

1. Acceptance of Terms

By accessing or using ShopKatalog (“the Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

ShopKatalog is an online marketplace platform that enables sellers to create shops, list products or services, and connect with buyers. We provide the platform infrastructure but do not directly sell products or services ourselves.

3. User Accounts

3.1 Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, including but not limited to listing prohibited items or engaging in fraudulent activities.

4. Prohibited Items and Activities

4.1 Pharmaceuticals and Health Supplements

ShopKatalog does NOT permit the listing or promotion of pharmaceuticals, drugs, or health supplements, regardless of claimed regulatory approvals.

This prohibition includes but is not limited to:

  • Prescription medications and drugs
  • Over-the-counter medications
  • Dietary supplements and nutritional supplements
  • Vitamins and mineral supplements
  • Herbal supplements and remedies
  • Weight loss pills and diet supplements
  • Performance-enhancing drugs and supplements
  • CBD, cannabis, or hemp-derived products
  • Any product making medical or health claims

4.2 Other Prohibited Items

The following items and activities are also prohibited:

  • Illegal goods or services
  • Weapons, firearms, ammunition, or explosives
  • Stolen goods or counterfeit items
  • Adult content or sexual services
  • Tobacco products or smoking accessories
  • Live animals or animal parts from endangered species
  • Hazardous materials
  • Items that infringe on intellectual property rights
  • Fraudulent or misleading listings

4.3 Enforcement

We actively monitor listings using automated systems and manual review. Violations will result in immediate listing removal and may lead to account suspension or permanent ban from the Platform.

5. Seller Obligations

5.1 Product Accuracy

Sellers must provide accurate descriptions, images, and pricing for all listed items. Misleading or false information is strictly prohibited.

5.2 Order Fulfillment

Sellers are responsible for fulfilling orders promptly and as described. Failure to fulfill orders may result in account penalties.

5.3 Customer Service

Sellers must provide responsive customer service and address buyer inquiries and complaints in a timely manner.

5.4 Compliance with Laws

Sellers must comply with all applicable local, state, national, and international laws and regulations, including tax obligations, licensing requirements, and consumer protection laws.

6. Buyer Obligations

Buyers agree to make purchases in good faith and to comply with payment obligations. Fraudulent purchases or payment disputes made in bad faith may result in account termination.

7. Fees and Payments

7.1 Subscription Fees

Certain features of the Platform may require payment of subscription fees. All fees are non-refundable unless otherwise stated.

7.2 Transaction Fees

We may charge transaction fees or commissions on sales made through the Platform. Fee structures will be clearly communicated to sellers.

7.3 Payment Processing

Payments are processed through third-party payment processors. You agree to comply with their terms of service.

8. Intellectual Property

8.1 Platform Content

All content on the Platform, including text, graphics, logos, and software, is the property of ShopKatalog or its licensors and is protected by copyright and other intellectual property laws.

8.2 User Content

By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting the Platform.

8.3 Copyright Infringement

We respect intellectual property rights. If you believe your copyright has been infringed, please contact us with details of the alleged infringement.

9. Disclaimers and Limitation of Liability

9.1 Platform “As Is”

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Third-Party Transactions

ShopKatalog is a marketplace platform. We are not a party to transactions between buyers and sellers. We do not guarantee the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of sellers to fulfill orders.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOPKATALOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify, defend, and hold harmless ShopKatalog and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Dispute Resolution

11.1 Disputes Between Users

Disputes between buyers and sellers should be resolved directly between the parties. We may provide support and mediation services but are not obligated to do so.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ShopKatalog operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

14. Severability

These Terms constitute the entire agreement between you and ShopKatalog regarding your use of the Platform and supersede all prior agreements and understandings.
